How Do I Report Copyright Infringement?

Notice and Procedure for Making Claims of Copyright Infringement

Zink Media, LLC (d/b/a Discogs) stores and publishes information on publicly available audio items on Discogs.com, under the fair use laws. If you believe that your work has been copied in a way that constitutes copyright infringement, please provide Discogs.com's copyright agent with the written information specified below. Please note that this procedure is exclusively for notifying Discogs.com that your copyrighted material has been infringed. We also recommend that you notify the alleged infringer directly.

Please carefully consider your claim prior to submitting the notice. Submitting false notices through this process may result in Discogs taking actions against your account, including, but not limited to, account suspension or termination. In addition, false statements in your notice may lead to civil or criminal penalties in your jurisdiction.

Required Materials and Information:

  • An electronic or physical signature of the person authorized to act on behalf of the owner of the copyright interest.
  • A description of the copyrighted work that you claim has been infringed upon.
  • A description of where the material that you claim is infringing is located on the site.
  • Your address, telephone number, and e-mail address.
  • A statement by you that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
  • A statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.

For convenience, you can complete the Notice of Copyright Infringement form to submit your notice to us. You do not need to be signed into an account to submit this form. If you choose not to use the form, you can submit the above information directly to compliance@discogs.com

Notice and Procedure for Making Counterclaims

For United States-based rights holders, pursuant to the Digital Millennium Copyright Act, if your listing was reported and you believe your listing was removed in error, then you have the right to submit a counterclaim. We also recommend that you contact the party that made the original claim directly. If the party that made the original claim has made a mistake, then they will need to contact us directly to retract their original notice.

United States-based rights holders may file a counterclaim by sending the following information to our Copyright Agent. Please carefully consider your counterclaim prior to submitting it. Submitting false counterclaims through this process may result in Discogs taking actions against your account, including, but not limited to, account suspension or termination. In addition, false statements in your written counterclaim may lead to civil or criminal penalties.

Required Materials and Information:

  • Your electronic or physical signature.
  • A description of the material that has been removed.
  • A description of where the material is located on the site.
  • A statement by you, made under penalty of perjury, that you have a good-faith belief that the material was removed as a result of mistake or misidentification of the material to be removed.
  • Your address, telephone number, and e-mail address.
  • A statement that you consent to the jurisdiction of the United States federal district court for the judicial district in which your address is located, and that you will accept service of process from the person who provided the complaint set forth above. 

Once we receive a valid counterclaim, we'll provide a copy of the complete claim, including your contact information, to the original complainant to inform them that the listings will be reinstated after 10 business days if they don't inform us that they have filed an action seeking a court order to restrain you from relisting the items.

Repeat Infringer Policy
